The Promise and Peril of NFTs for Big Media

Non-fungible tokens offer the allure of a new media format, a new window and a new revenue stream? What’s not to like? Quite a lot, actually, especially if you happen to work with traditional media. This panel of experts, drawn from major media, startup crypto tech and securities law, will discuss the scope of the opportunity, including some exciting innovations that have not yet been widely adopted; and it will also set forth the many potential pitfalls for major media firms, including securities law, taxes and obligations to talent, guilds and other stakeholders.

Fred Kreuger, Managing Partner, SoftAtom: Fred Kreuger has launched 10 companies. He built the Proton blockchain, Proton wallet and NFT market. He is currently investing in NFT technology. Fred is a former Wall Street prop trader on the Salomon Brothers Arb Desk and with Greenwich Capital Markets. He studied Operations Research and obtained a Phd in Statistics from Stanford.



Josh Lawler, Partner, Zuber Lawler LLP: Josh Lawler’s primary areas of practice are in mergers & acquisitions and securities law. Mr. Lawler practices at the cutting edge of law relating to emerging industries and technologies, including cannabis and distributed ledger technology. His M&A clients include private equity groups, public and private companies, fundless sponsors, family offices and sellers of large assets. In collaboration with multi-lingual colleagues, Mr. Lawler often works across languages and sovereign borders to execute international transactions. He’s worked in relation to over 20 countries over the past several years. Many of his clients are domiciled outside of the United States. Mr. Lawler leads the firm’s Emerging Technologies Group, with a particular emphasis on Blockchain (distributed ledger), cryptocurrency, artificial intelligence, robotics, biotechnology, virtual/augmented reality, cybersecurity, and related technologies. In this capacity, Mr. Lawler counsels clients in respect to securities and regulatory matters, including issue of tokens and digitized assets; as well as development, licensing, commercial use, acquisition and disposition of all manner of intellectual property. As a dedicated futurist, Mr. Lawler brings enthusiasm and excitement to cutting edge projects. In addition to legal counsel, Mr. Lawler excels at providing solutions for clients with his significant problem solving skills and practical business advice. Many of Mr. Lawler’s clients rely on him as outside general counsel. Prior to joining Zuber Lawler, Mr. Lawler practiced as a corporate securities and M&A attorney at Skadden, Arps, Slate, Meagher & Flom LLP.

 

Yang Adija is SVP, Digital League Partners, Growth and Innovation for Turner Sports. In his role he is responsible for managing the overall business operations and daily execution of strategic and tactical initiatives for digital league partnerships with the NBA and NCAA. In addition, Yang leads Turner Sports’ innovation efforts, leading to the development and launch of an original IP franchise built on the blockchain and the organization’s industry-leading NFT efforts. In his previous role, Yang was VP, Business Operations and Strategy for Turner NBA Digital, in which he managed NBATV, NBA.com, the NBA App and NBA League Pass and worked closely with the League on communication and execution of new business development deals, strategic partnerships, and product initiatives. Yang has also held the position of Senior Director of strategy and research for Turner Content Distribution (TCD), the domestic distribution and marketing arm of Turner. In this role, he was responsible for developing business strategy for multi-platform content distribution and monetization opportunities in new evolving markets across Turner’s portfolio of networks and brands. Yang was also instrumental in launching FilmStruck, Boomerang and the Turner Podcast Network, new direct to consumer products for Turner. Prior to joining Turner, Yang was a director in KPMG's advisory practice in Atlanta. As a finance lead, he was responsible for creating and engaging partnership strategies and managed key growth initiative metrics for some of KPMG’s largest international clients. Yang also served in several capacities with the Walt Disney Company including manager of planning, providing financial support during the digital transformation of Disney’s feature animation film business, as well as playing a key role in analyzing Disney’s cable network business. Yang obtained a Bachelor of Science degree in Economics from the Wharton Business School at the University of Pennsylvania and holds an MBA from Fordham University.

 

Robert Tercek is an award-winning author, entrepreneur, and educator focused on the process of dematerialization. Mr Tercek is a seasoned business executive with deep expertise in digital media and internet services. He is a prolific creator of interactive programs and products. He has designed and launched successful consumer experiences on every digital platform, including digital television, game consoles, broadband Internet, and mobile networks. In 2021, Mr. Tercek was recognized as the Humanitarian of the Year by the Media Excellence Awards for his leadership in designing and launching COVID SMART™, an interactive training program designed to keep workers safe on the job during the pandemic. Tercek's book "VAPORIZED: Solid Strategies for Success in a Dematerialized World" was selected as the 2016 International Book of the Year at the Frankfurt Book Fair by the editors of GetAbstract from a field of 10,000 business books. VAPORIZED established Tercek as a global authority on the process of dematerialization into software that today is transforming every industry. In the media industry, where this process began, he has long been recognized as a thought leader. In 2009, he was named one of the “25 Executives to Watch” by Digital Media Wire. Variety has named him one of the “Digital Dozen” most influential players in new media. The Industry Standard dubbed him the “TV Anarchist”. His 22-year career is marked by achievements in vaporized mass media:

• The launch of MTV: Music Television throughout ASIA and the first multichannel satellite television service in Asia (STAR TV in 1991);

• The first multiplayer Java games on the World Wide Web (Sony, 1997);

• The first interactive game shows on US Television (Sony, 1999);

• The world’s first streaming video service on mobile phones (PacketVideo and NTT DoCoMo’s V-Live, 2001);

• The largest audience for live interactive education on the web (Oprah Winfrey’s 2009 “Live Your Best Life” webcasts);

• The most popular free book download in history (Suze Orman on Oprah.com, 2009).

Tercek has led the process of digital change in executive leadership roles at major media companies. Until 2010 he was President of Digital Media at OWN: The Oprah Winfrey Network. Previously he was Senior Vice President of Digital Media at Sony Pictures Entertainment and earlier, the Creative Director at MTV: Music Television. He also co-founded five startup ventures, including 7th Level, Inc, a pioneering game publisher that went public in 1993. Today Mr Tercek is the founder and CEO of General Creativity, a strategic advisory firm that provides insight and advice to corporations as they contend with digital transformation and the process of dematerialization into software. His client roster includes: IBM, Google, JD Power, Microsoft, Reed Exhibitions, NBC Universal, AT&T, WarnerMedia, PBS, HPE, Nokia, Motorola, AMD, MSN, Sony Computer Entertainment, Taito, Bandai Networks, Siegel and Gale, Deloitte, EY, PwC, CMP Media Group, VNU Media Group and GS1 US. He has also served as an advisor to several successful startups, including BrightCove, M.Metrics (acquired by Comscore), MediaCode/Muse.net (acquired by Yahoo) and NevenVision (acquired by Google).
