AI & the Creative Community – Representing the Interest of the Artist - This is a Far from Settled Question
While the Hollywood strikes of yesteryear may now be old news, the concerns of the Guild membership, the writers and actors are far from settled. And the news of “AI Lawsuit Progress,” may simply be disconcerting. After all, creative concerns cannot always be resolved through arbitration and legal settlement. AI at its best may prove to be a fantastic aide, speeding up the “Create Process,” but perhaps an artist doesn’t want the process accelerated, even if the product is a little better. The underlying issues of Artificial Intelligence, from Deep Fakes, Image Provenance, Virtual Humans and the ultimate ability of the AI to reason, think and author creative works is far from settled fact. Who among us can say what the future might hold. For those of you who have tried AI or perhaps have even become “Expert” in AI application, you are aware of the problems it may present. AI can as easily violate copyright of everything from image to story to voice as it can enhance the creativity of the most sophisticated artist. This our world to explore.

Nyasha Foy, Business and Legal Affairs Executive; Board Member, Black Entertainment and Sports Lawyers Association: Nyasha Shani Foy is a multi-hyphenate business & legal affairs executive, board member, creative and thought leader. In her practice, she advises, counsels and navigates executive management teams at early stage start-ups, scale-ups, iconic global brands and established firms in the areas of advertising, intellectual property, entertainment, marketing and media law. Nyasha has served in senior business and legal affairs roles at Buzzfeed, Broadway Video, Complex Media, Horizon Media, VICE Media Group, and Sotheby’s as their first Vice President and Assistant General Counsel, NFTs. She brings a wealth of experience in brand partnerships, emerging technologies and activations, such as ComplexLand and ComplexCon. Outside of her professional life, Nyasha serves as Vice Chair of the Save the Music Foundation Board, on the Board of Directors for the Black Entertainment and Sports Lawyers Association (BESLA), and as Vice Chair of the New York State Bar Association, Intellectual Property Law Section. She is a writer, producer and frequent speaker known for her dynamic insights on topics ranging from lifestyle and culture to intellectual property and AI. Nyasha received her B.A. in Music and French from Wesleyan University, and her J.D. from New York Law School. She is admitted to practice in California and New York. Nyasha is also a member of Delta Sigma Theta Sorority.
Gabby Ziccarelli, Legal Advisor & Artist: Gabby Ziccarelli is an award-winning legal advisor, author, guest lecturer, podcast host, advisor to the Choreographers’ Guild, stage and film actress, dancer, and vocalist. She is a zealous advocate and artist who has devoted her career to supporting innovators & creators from all backgrounds - ranging from individual artists to startups to Fortune 5 companies. The breadth and depth of Gabby’s expertise includes successfully securing intellectual property rights for creators, negotiating strategic licenses to help creators monetize their work, litigating intellectual property infringement disputes in jury trials, navigating complex regulatory frameworks, and much more. She's worked in the artificial intelligence space since 2018, with experience working with complex technologies ranging from quadruped and self-driving robots, spatial computing, augmented reality, and wearables. She was one if the lead attorneys that advised on the build of the Apple Vision Pro AR/VR operating system. Gabby’s work has been featured in publications such as The Chicago Tribune, The Baltimore Sun, Venture Beat, and The World Intellectual Property Law Organization Magazine. She's also been featured as a legal commentator on radio shows and podcasts such as NPR's Airtalk, Techdirt, and This Week in the Law.
Mary T Duda,AI XR: VR/AR: Pioneer, Futurist, Media Eco-System Expert.: Duda has been a multimedia technology industry leader, fine artist, author, and forward thinker for over three decades. Starting out with the technological explosion in the early 1980s, Duda developed a reputation as an authoritative voice in the development and application of multimedia technology. After founding her own digital media company, Duda Design, Inc., she quickly gained acclaim as technical director for Disney World’s EPCOT Grand Opening, which utilized display technology and animation in ways never before realized. Upon completing her work with Disney, Duda became the leading multimedia architect for the Los Angeles Olympic Committee. Duda then went on to work with AFI (American Film Institute), the US, Canadian, and Indonesian Governments and to develop next-generation ‘edutainment’ programs for publishers such as Houghton Mifflin. In the 1990s, Duda worked to improve and establish computer graphics, animation, and interactive media certificate programs at UCLA. In 1996, Duda pioneered the team responsible for “A Virtual Day in Paris,” one of the first live tourist cybercasts in history sponsored by APPLE Paris. In 2000, Duda established Virtue Arts, a technology software company. As CEO/President of Virtue Arts, Duda has used her extensive knowledge of multimedia software to develop industry-leading production tools. In 2003, Duda launched VirtuePlay, a digital game developer dedicated to games and virtual reality applications, in 2006. VirtuePlay released the first VR simulation of the 3D Lunar surface using NASA’s data to run VR on normal laptop computers with motion seats and military-grade HMDs. In 2013, Duda created the MoonPlay brand to merge VR games with simulation using NASA’s planetary data. In 2020, SciOart was launched to combine science learning and virtual world (metaverse) simulations for fun experiences and 'stealth' education. Duda is doing her Ph.D. dissertation on AI XR Ethical Frameworks in Education. And accelerated learning using immersive simulation techniques in extended reality (XR) at Pepperdine University. She lectures worldwide on AI/XR, Animation, Digital Games, and Advanced Learning Systems. Duda continues to consult for current technology adaptation. She is a leading proponent of non-violence in digital games and ethics in AI and XR simulations. As a fine artist, she has an exhibit and book on the history of Art and Tech and its influences on society in development for 2024.
