New AI Regulation in the EU and US: What to Expect and How to Prepare

While the EU and US are on distinct and different timelines – the EU AI Act was adopted this past June and the US is still in the “Talking Stage,” with the White House issuing a “Blueprint for an AI Bill of Rights” late last year, there are significant similarities in the language between the two. Each emphasize principles of civil liberties and privacy, data transparency, guardrails concerning abuse and harm. But the EU and US diverge significantly on regulation and governance. In this session, we bring together experts in the law and technology who will enlighten us on how our cross-Atlantic AI future is likely to unfold.

Marc Martin, Partner, Perkins Coie: Technology, media, and telecom law attorney Marc S. Martin provides regulatory, transactional, and strategic advice to developers, service providers, manufacturers, entrepreneurs, investors, and enterprise customers. He negotiates agreements in the areas of technology and content licensing, supply chain procurement, and cloud and wireless service agreements, among other platforms. Marc’s recent successes include negotiating the industry’s first 5G-connected AR/VR device distribution agreement with a leading wireless carrier. He has advised several leading technology firms in launching new products and services, particularly those subject to Federal Communications Commission (FCC) and privacy regulation. Marc is ranked as a leading communications lawyer by Chambers USA, Best Lawyers in America, and Washington, D.C., Super Lawyers. He serves as chair of the firmwide Communications industry group, co-chair of the firmwide Strategic Growth Working Group, and is a member of the firmwide Audit Committee and the Washington, D.C., office hiring committee.


Benoît Barre is a tech lawyer with over 20 years’ experience advising European and international clients on technology transactions, ele\tronic communications, digital regulation, and data protection. In addition to his prior experience at several law firms dedicated to supporting innovation, Benoît gained extensive in-house expertise, having spent 14 years at Apple, serving as Head of Legal for France / CEMEA, and Head of Telecom Legal for EMEA. Benoît leads the firm’s digital practice. Notable experience: Assisting leading US digital companies with the negotiation of strategic agreements with European partners (including electronic communication operators); Advising foreign electronic communication operators and service providers on multiple aspects of the French electronic communication regulation (notably the French implementation of the EECC); Advising online advertising players on sensitive ePrivacy-related matters; Advising a large variety of online players on compliance challenges related to their respective business models, including providing advice on regulatory requirements pertaining to online platforms, digital assets, influence marketing, international data transfers
