| Tuesday, October 2 3:00 PM - 4:00 PM Session A: Intellectual Property Rights - Threat by Region - Threat by Technology Enforcing intellectual property rights is an industry unto itself and it functions on multiples levels. On its most prominent and public face, it is the digital distribution of content that is the greatest threat. Digital theft via the Internet is an international enterprise - unfettered by boundaries. Interesting to note, more than have of the 50 million plus members of the Napster community were from outside the United States. However, in this session, we will not be focusing on the Napster, digital download, copyright protection issues, they are being discussed in many Digital Hollywood seminar sessions. In this session we will focus on how intellectual property rights are being protected in various parts of the world, in Asia, Southern Asian, South America, in Europe, the Mideast as well as in the United States. How do governments cooperate. What is the exposure of the entertainment industries in various regions and how does the legal system serve to inhibit the threat? While the growth of the entertainment industry and the expansion of world product can be massive, the threat of loss can be equally great. Felder, Partner, Brown Raysman Millstein Felder & Steiner LLP Robert Freedman, Senior Vice President, Technical Operations Optical Media, Crest National Mark Vega, Partner, Greenberg Traurig, LLP, Moderator Additional speaker to be announced Ray Uhlir, Vice President Marketing, DataPlay: As vice president of marketing for DataPlay, Inc., Raymond K. Uhlir, Jr. is responsible for developing and overseeing the daily execution of marketing and channel development strategies. Mr. Uhlir came to DataPlay from IBM, where he most recently served as global marketing executive for IBM's customer relationship management (CRM) e-business division. Mr. Uhlir was responsible for the marketing strategy behind the deployment of three major websites. Mr. Uhlir was also program director for IBM's licensing and business development division. In just over a year, he facilitated 10 strategic partnerships with more than 12,000 reseller outlets and a guaranteed profit annuity of over $40 million. Prior to working for IBM, Mr. Uhlir worked as a program manager for Raytheon Corporation and as an engineering supervisor for E-Systems, Inc. Mr. Uhlir holds a bachelor of science degree in electrical engineering from Auburn University and master of science degree in engineering management/marketing from George Washington University. Mark Vega is an Of Counsel in the Los Angeles office of Greenberg Traurig, LLP, a full-ser vice international law firm. He focuses his practice on entertainment, information technology and new media matters. Vega provides services to traditional film distributors and producers, as well as new media entrepreneurs who have emerged from the filmed entertainment arena. He also represents a wide variety of emerging and established technology companies. Vegas experience includes: transactional entertainment-related matters in the film and television industries; entertainment-oriented new media issues, including negotiation of all varieties of content arrangements, licensing agreements and strategic counseling; representation of film distributors, producers and other entities involved in the creation, exhibition and other exploitation of entertainment content; customer and vendor oriented website creation, development, maintenance and service agreements; creation of Application Service Provider license structures for mid-level companies; negotiation and drafting of outsourcing contracts for emerging and established technology companies; negotiation and drafting of B2B exchange vendor agreements; and counseling regarding overall new media strategies. Vega earned his law degree, and his undergraduate degree, magna cum laude, from the University of Arizona.Kenneth A. Jacobsen, SeniorVice President and Director, World Wide Anti-Piracy Operations, MPA: Mr. Jacobsens tenure with the Association began in January 1995, when he was named Staff Supervisor, USAPO. He was promoted to Senior Staff Supervisor, USAPO, in December 1997, to Vice President and Director, USAPO in May 1998 and to his current position in April, 2000. Prior to joining the Association, Mr. Jacobsen enjoyed a successful career with the Federal Bureau of Investigation, which began in 1969. At the time of his retirement from the FBI in January 1995, Mr. Jacobsen held the position of Supervisory Special Agent. In this capacity he was responsible for supervising criminal investigations in the greater Los Angeles area. In 1966 Mr. Jacobsen was awarded a B.A. Degree with Honors in the Directed Studies Program from Valparaiso University. He attended Northwestern University School of Law and received his J.D. Degree in 1969. He is admitted to the practice of law in the State of California and before the United States District Court, Central District of California. While employed by the FBI, the Los Angeles County Board of Supervisors recognized Mr. Jacobsen for his service on the Los Angeles County Task Force on Drug Abuse. In 1994 the Federal Executive Board of Los Angeles presented him with an award for Outstanding Supervision. During 1999 he sat on the State of California Governors Advisory Committee on High Technology Crime. Mr. Jacobsen resides in Southern California with his wife Becky. They have a grown daughter and two grown sons. Barry G. Felder, Partner, Brown Raysman Millstein Felder & Steiner LLP: Barry G. Feld er joined Brown Raysman in 1986 and is a partner and chair of the Litigation Department. His practice emphasizes disputes relating to the Internet, including web-related trademark infringement and dilution claims and domain name controversies. He also has extensive experience in matters involving software ownership and use as well as technology-related contract and licensing disputes. Mr. Felder has represented well-know entertainment companies in cutting-edge litigations involving trademark and copyright licensing issues. Mr. Felder is a member of the bars in the states of New York, California and New Jersey, along with many federal district courts in those states. He is also admitted to practice law before the Second and Ninth Circuits as well as the United States Supreme Court. Robert Freedman, Senior Vice President, Technical Operations Optical Media, Crest National: Robert Freedman is Senior Vice President, Technical Operations for Crest Nationals optical media manufacturing division. Mr. Freedman joined the company in 1995 and he spearheaded the establishment of Crest Nationals CD/DVD manufacturing facility for which he oversees all technical operations. Mr. Freedman is a member of the RepliTECH Optical Disc Advisory Board, several DVD Forum committees including the Verification Policy Committee, Verification Communications Group, and Working Group 2, and he is a founding member of the IRMA Anti-Piracy Task Force. Previously, Mr. Freedman was with Kao Infosystems Company for 8 years. He has been involved with the worldwide manufacturing and fulfillment of major software releases, including the Windows 3.X series, Windows 95, OS/2, the Novell 3.X series and the Novell 4.X series software. Mr. Freedman has been qualified as an expert witness by many international courts in regards to the manufacturing of optical discs and the piracy of optical disc based intellectual property. He has provided expert assistance to the anti-piracy efforts of the United States Customs Service, Business Software Alliance, Recording Industry Association of America, Microsoft, and developers of optical disc based intellectual property. |
