Social media and online marketing have been with us for almost a decade, but you'd think that websites and online marketers were still cowboys in the Wild Wild West. THE LAW IS NOW IN TOWN. The FTC and State attorneys general are on the lookout for internet marketers that fail to comply with sweepstakes and contest laws and laws related to the collection of personal information and they are drawing the big guns against them with hefty fines and shutdowns. In addition, websites are soliciting user-generated content that can subject them to infringement and defamation claims unless they set up their sites in specific ways to gain legal immunity. Join this very practical workshop to learn the basics of how to conduct sweepstakes and contests legally; how to collect User Generated Content without being subjected to claims of copyright infringement, defamation and other claims; how to develop a Terms of Use for your site that effectively protects you and your users; and how to develop and follow a privacy policy that reduces your risk of a shootout with regulators.

Anne Moebes, Law Office of Anne Moebes, Moderator: Anne Moebes is a sole practitioner who provides legal advice in connection with traditional and online promotions and advertising, including FTC and state law compliance for sweepstakes and contests (including rules and other documentation), collection of personal information, email marketing, green and cause marketing, buzz, stealth and viral marketing, truth-in-advertising, and intellectual property and right of publicity clearance as well as drafting and negotiating complex new media, online and traditional marketing, advertising and consulting agreements. Formerly, Ms. Moebes served as VP, Business and Legal Affairs for Walt Disney Studios Motion Pictures, where she managed the film marketing legal division, including closing numerous content deals with high-profile companies, e.g., Yahoo, Facebook, Apple, Amazon and Major League Baseball and advising high-level executives in all of the above matters. Ms. Moebes is a graduate of Georgetown University Law Center and North Carolina Central University School of Law.

Amy Ruskin,
Senior Director, Business and Legal Affairs, Myspace, Inc.: Amy Ruskin is the lead promotions attorney for Myspace and oversees all sweepstakes, user-generated contests, and auditions. Ms. Ruskin advises on the legalities and structure of promotions, including compliance with federal and state privacy and sweepstakes laws and negotiates and drafts a wide spectrum of agreements, including production and talent agreements, marketing, advertising and promotion agreements, content licenses and technology transactions. Ms. Ruskin is a graduate of Southwestern University School of Lawand New York University.

Charles Hurr, Disney Interactive Media: Charles Hurr is a lawyer with the Disney Interactive Media Group where he focuses on ecommerce and social media matters. He advises businesses across The Walt Disney Company on user generated content initiatives, which touch on many of the legal issues addressed in website terms of use and privacy policies. Charles is a graduate of USC Law School and Rice University.

Seth Weisberg, Chief Legal Officer and Secretary, Stamps.com: Seth Weisberg has served as Chief Legal Officer since April 2008. Mr. Weisberg previously served as Vice President and General Counsel from March 2001 until April 2008, and served as Senior Director, IP & Licensing from June 1999 until March 2001. Mr. Weisberg previously was an associate at Irell & Manella LLP, worked as a software developer and founder at Shortcut Software, created physical computer models at RAND Corporation and was a high school teacher in the Mississippi Teacher Corps. Mr. Weisberg holds a law degree from Columbia Law School, a master's degree in History from Harvard, a bachelor's degree in Physics and Astronomy from Harvard and a General Course Certificate from the London School of Economics. Mr. Weisberg is a registered patent attorney.
