Track III: Content Rights - Digital Rights - Entertainment & Technology Track Piracy and Digital Rights Management: Legal, Legislative and Social Issues Surrounding DRM and Anti-Piracy Implementation While there may be no short term fix when it comes to the evolving relationship of the digital technologies and its impact on music, film and information content distribution, what we can perhaps all agree on is that it is becoming a more sophisticated and complex relationship. As broadband grows, with it come not only threats to rights holders, but also potential solutions and new attitudes in public behavior. All the news is not bad. While the adversarial positions in the legal process may not be softening and the legislative proposals continue to weave through the system, there are many factors in the technological space as well as in the marketplace which may come to mitigate or even change the flow of history. In this session, we bring together a group of the primary players in the field, looking to exchange ideas and give us a roadmap for the future. Jim C. Williams, Senior Vice President & Chief Technology Officer, Motion Picture Association of America, Inc (MPAA): Jim Williams leads the Office of Technology for the Motion Picture Association of America, Inc (MPAA) in its efforts to facilitate a smooth digital transition that provides consumers new ways to enjoy Hollywood content when, where and how they want. Jim works closely with the six major motion picture studios to advance movie and television producers interests throughout the world in various technology-related capacities, including content protection license negotiation, license enforcement, industry relations, government relations, pro-technology public outreach and standardization. Jim joined the MPAA in 2002. Prior to joining the MPAA, Jim spent nearly 20 years with Hughes/DIRECTV, advancing from a skilled hardware, software and chip designer to a seasoned entertainment executive responsible for up to 300 employees and up to 70 development engineers. In 1997, he led the business startup of DIRECTV Japan, the fastest full-scale Direct Broadcast Satellite startup in history. In 1998, he led the launch team for the first U.S. nationwide HDTV service. Starting in 1999, Jim led the DIRECTV set-top box development team. Jim holds a Bachelor of Science degree in Electrical Engineering from the University of California, Los Angeles and a Master of Science degree in Computer Engineering from California State University, Long Beach. Jim holds thirteen (13) U.S. patents with another seven (7) U.S. patents pending. Jim has won six (6) Technology and Engineering & Advanced Media Technology Emmy Awards as part of various engineering teams. Jim serves on the Board of Directors of Mastermedia International. Jim is a prolific public speaker and author, having delivered over fifty addresses on five continents.
Paul Jessop, Chief Technology Officer, IFPI: Paul Jessop acts as Consultant for the RIAA on a secondment from IFPI, its London-based international counterpart. He heads the Technology and Standards department and oversees all the collective technical activity in the industry. He works closely with both associations legal departments on the evolution of internet related legislation and with industry anti-piracy experts in both the online and offline worlds. Central to the associations leadership in the transition to internet delivery of music is the development, promotion and operation of identification schemes International Standard Recording Code (ISRC) for tracks and the Global Release Identifier (GRid) for electronic distribution both of which are managed by Pauls department. Paul is a Chartered Engineer, a Fellow of the Institution of Engineering and Technology and a Member of both the Audio Engineering Society and the Royal Institution of Great Britain. He obtained a degree in Engineering and Computer Science at Cambridge and a post-graduate Diploma in Management Studies at Oxford. Paul enjoys travelling with his wife and two sons, who are all qualified scuba divers. Paul is a Divemaster and has held an amateur radio licence since 1975. He recently returned to flying gliders in both the UK and the US.
Albhy Galuten is Vice President of Digital Media Technology Strategy for Sony Corporation of America (SCA). In addition to his technological achievements, Mr. Galuten is a Grammy award-winning record producer, songwriter and arranger. Mr. Galuten joined SCA in March 2005, and is responsible for the Media Technology Group. The Media Technology Group assists with technology strategy and due diligence, research & development, relationships with the content industry and the development of standards. Before coming to Sony, Mr. Galuten was Senior Vice President, Advanced Technology, Universal Music Group. Under Mr. Galuten, eLabs and Universals Advanced Technology group provided: strategic advice to senior management in the technology space, performed technical due diligence of software, hardware and business systems, invented technology and filed patents. Under Mr. Galuten, the group also managed standards participation, negotiated technology licenses and provided technical support for lobbying efforts and trade organizations. Before working at Universal, Mr. Galuten was a Vice President at ION where he created and developed the Enhanced CD. Prior to working in technology Mr. Galuten was a musician and record producer. In 1978 he won two Grammy awards including Producer of the Year. His original compositions and orchestrations for Film, Theatre and on record have won him a Dramalogue Award and two BMI Awards. During his music career which spanned more than 20 years, Mr. Galuten worked with numerous multi-platinum artists, produced eighteen No. 1 singles, and generated sales of more than 100 million records.
Susan Cleary, Esq., Vice President, General Counsel, Independent Film and Television Alliance®: Susan Cleary serves as vice president and general counsel of the Independent Film and Television Alliance®, where she has worked for the past 10 years. IFTA® is the trade association of independent production and distribution companies, affiliated financial institutions worldwide and owner/organizer of the American Film Market. As head of the IFTA legal department, Ms. Cleary focuses on international licensing and distribution, new media, intellectual property protection, market conditions and government relations. Additionally, she oversees IFTA Arbitration, an international arbitration tribunal; and IFTA Collections, a division of IFTA that collects cable retransmission royalties and blank tape levies for disbursement to independent rights holders. Ms. Clearys past business and legal affairs positions include experience in both production and distribution. Serving as associate counsel at the Motion Picture Association of America, she coordinated international copyright litigation on behalf of the major Hollywood studios. She also was production counsel for World of Wonder Productions, an independent producer of cable and reality programming. Ms. Cleary began her legal career at Saban Entertainment, supporting all acquisition- and production-related agreements, as well as script, set and prop clearance on a wide range of childrens television programming (including Mighty Morphin Power Rangers, Sweet Valley High and numerous made-for-television movies). Beginning her college studies at New York University, Ms. Cleary earned a Bachelor of Arts degree in political science and Masters of Arts degree in liberal studies at Rutgers University in New Jersey, then went on to receive a juris doctorate degree from Southwestern University School of Law in Los Angeles. She is a member of the California and District of Columbia Bar Associations. Ms. Cleary serves as past chairman and, currently, an executive board member of the Intellectual Property and Entertainment Law Section of the Los Angeles County Bar Association. She is also an advisory board member to the Donald E. Biederman National Entertainment and Media Law Institute at Southwestern University School of Law, and editor of the IFTA Model International Licensing Agreements (3rd and 4th Eds.). It is comprised of model distribution contracts, including standard terms and definitions, as well as agreements for Internet and wireless distribution. Ms. Cleary co-authored Developing an Internet and Wireless License Agreement for Motion Pictures and Television Programming. The Journal of International Media and Entertainment Law published the article in 2007.
Virginie L. Parant is a partner with Artist Law Group. Her practice encompasses all aspects of the entertainment and media industries, with a focus on the convergence of content and technology. Prior to co-founding ALG, Ms. Parant was Vice-President of Business Affairs for XingMail, Inc., an online music marketing company. Ms. Parant started her career at Gunderson Dettmer, LLP., a leading Silicon Valley law firm, where she developed a cutting-edge practice, representing a broad range of clients in new media transactions. Ms. Parant received an LL.M. from the University of California at Berkeley, School of Law (Boalt Hall). She also holds a D.E.A. de Droit de la Propriété Littéraire, Artistique et Industrielle (LL.M. in Intellectual Property Law) with Honors and a Maîtrise en Droit Privé (J.D.) with High Honors from Paris University (known to many as the Sorbonne). A European Union Erasmus Scholar and former Assistant Editor for ABA publication the Entertainment and Sports Lawyer, Ms. Parant has published numerous articles on copyright law. Her 1996 article, Copyright Enforcement in a Digital Environment, was selected for republication in the American Bar Associations Best-Of-The-Year issue. Named by Southern California Super Lawyers a Rising Star for 2005, Ms. Parant is regularly featured as a speaker at various industry events. She was also featured as regular on-air legal analyst on E! Entertainment (French affiliate) for the 2005 Michael Jackson trial.
Jason Oxman, Senior Vice President, Industry Affairs, Consumer Electronics Association: Oxman is Senior Vice President of Industry Affairs for the Consumer Electronics Association. A seasoned veteran of technology and policy for over a decade, Oxman has served the federal government and private sector as a technology expert and communications strategist. At CEA, he oversees four departments with a combined staff of 50 professionals in the communications, member relations, market research, and strategic relations departments. As a senior executive at CEA, Oxman is responsible for developing and overseeing implementation of strategies for CEAs portfolio of technology issues. Prior to joining CEA, Oxman was Managing Director of Law Media Group, a multidisciplinary public relations firm serving technology clients. Over the past decade, he has held senior executive positions in corporations and trade associations, including General Counsel of a telecommunications industry trade association and Vice President of a Silicon Valley-based technology company. Oxman also worked under two different Federal Communications Commission chairmen to develop and implement technology and broadband policies. A former broadcast journalist at both commercial and public radio stations, Oxman is also a lawyer. Oxman holds a B.A. cum laude from Amherst College, an M.S. in Mass Communication from Boston University School of Communication, and a J.D. from Boston University Law School.
