Piracy and Digital Rights Management: Legal, Legislative and Social Issues Surrounding DRM and Anti-Piracy Implementation
While there may be no short term fix when it comes to the evolving relationship of the digital technologies and its impact on music, film and information content distribution, what we can perhaps all agree on is that it is becoming a more sophisticated and complex relationship. As broadband grows, with it come not only threats to rights holders, but also potential solutions and new attitudes in public behavior. All the news is not bad. While the adversarial positions in the legal process may not be softening and the legislative proposals continue to weave through the system, there are many factors in the technological space as well as in the marketplace which may come to mitigate or even change the flow of history. In this session, we bring together a group of the primary players in the field, looking to exchange ideas and give us a roadmap for the future.

Paul Jessop heads the technology department of IFPI, the trade association that repre sents the international recording industry. As Chief Technology Officer, he is responsible for all the collective technical activity in the industry. He works closely with IFPIs legal department on the evolution of internet related legislation and with IFPIs anti-piracy experts in both the online and offline worlds. Central to IFPIs leadership in the transition to internet delivery of music is the development, promotion and operation of identification schemes International Standard Recording Code (ISRC) for tracks and the Global Release Identifier (GRid) for electronic distribution both of which are managed by Pauls department. Paul is a Chartered Engineer, a Fellow of the Institution of Electrical Engineers and a Member of both the Audio Engineering Society and the Royal Institution of Great Britain. He obtained a degree in Engineering and Computer Science at Cambridge and a post-graduate Diploma in Management Studies at Oxford. Paul enjoys travelling with his family a wife and two sons, who are all scuba enthusiasts. Paul is a Divemaster and has held an amateur radio licence since 1975. He rides a BMW motorcycle and hopes to return to flying gliders as soon as the current issues in online music piracy are resolved.
Howard Silverman is Secretary of the SVP Alliance, a group of media and technology industry leaders committed to the secure, widespread use of digital content on consumer devices. In this role he is responsible for the running of the alliance, business development, and working together with Alliance members to build SVP solutions into their product roadmaps. Howard has over 15 years experience working in the Israeli high technology sector in various marketing and business development roles. Howard graduated from Keele University in the UK in 1990 in Management and Computing, and in 2006 was awarded an MBA from Bar Ilan University in Israel.
Ted Shapiro, Deputy Managing Director, Vice President and General Counsel - Europe - Motion Picture Association (Brussels), is responsible for the MPAs European legal affairs including representing the interests of the MPAs member companies in Europe and advising them on industry matters related to copyright (in particular new media), audiovisual law (including casting regulation), competition matters, international private law, data protection and international trade law as well as litigation oversight on industry-related matters, such as technological measures and support to the Anti-Piracy department on enforcement matters. Mr. Shapiro also represents the MPA on content protection matters in Europe in industry consortia and standards bodies such as the Digital Video Broadcasting project. He also works with the ancillary rights department on the legal aspects of negotiations and relations with collecting societies such as AGICOA (audiovisual producers collecting society). Ted is admitted to practice in Massachusetts and England/Wales. He has a LL.M. from the University of Amsterdam, a J.D. from the Dickinson School of Law and B.A. from Connecticut College.
Bill Murray is President of William Murray & Associates, a consulting firm focused on d eveloping international media strategies for digital content protection, audiovisual regulation, film production tax policy, and international government relations, with clients including venture capital firms, governments, and media companies. Before consulting, Bill was Executive Vice President and Co-Chief Operating Officer of the Motion Picture Association (MPA), the international trade association representing the international interests of the major Hollywood studios. During his time at the MPA, Bill was instrumental in designing a framework for Hollywood to respond to the challenges presented by changing technology. Rather than simply attacking piracy in the traditional fashion, Bill developed a multi-disciplinary approach which addressed the legislative, public relations, legal, and technological aspects of the issue, an approach intended to allow film and television producers to maximize the potential of new technology while aggressively confronting piracy threats. Over a 20 year career at the MPA, Bill designed the MPAs first strategic plan, worked with a variety of foreign governments on film production and trade policy, and held a series of positions at the MPA that included responsibility for the Associations international operations, strategic planning, market research, and digital strategy Bill is a frequent speaker on the entertainment industry, having addressed the International Federation of Film Producers, the Los Angeles Consular Corps, the Banff World Television Conference, the Rio de Janeiro Film Festival, the Toronto International Film Festival, the ShoWest motion picture industry convention, and university audiences including UCLA, Pepperdine, Thunderbird, and USC, where he delivered the keynote address at the 2003 Marshall School of Business International Case Competition. He has served on the Board of a number of key industry organizations such as AGICOA (the Association of International Collective Management of Audiovisual Works), the Canadian Copyright Collective, FIAPF (International Federation of Film Producers Associations), the International Video Federation, the US-Mexican Film Bilateral Committee, and the Franco-American Cultural Fund. Mr. Murray holds a dual-discipline B.A. in Business Administration and English Literature from Albright College in Reading, Pennsylvania, and an M.B.A. in International Management from Thunderbird, the Garvin School of International Management in Glendale, Arizona.
