Every segment of the music industry has come under attack in the past three years and it has thrown the industry upside-down. At first, the explosive popularity of the Internet and file-sharing focused attention on a supposed non-responsive and greedy industry. That feeling was replaced by an embrace of technology innovation and a rush into a tech future where all problems would take care of themselves as everyone, from executives to artists to consumers bathed in the prosperity of the Internet revolution. Unfortunately, nothing worked out. The industry is in a financial and technological crisis, crippling the bottom line of every segment of the industry, from the artist and management, to the retailer, the tech company, the producer finally to the indie and the major labels themselves. This is an industry in flux. Demand has never been stronger, but the delicate balance between the interests of artists, labels, the channels of distribution and the consumer has never been more illusive. Kenneth Hertz, Senior Partner, Goldring Hertz Lichtenstein and Haft LLP, Moderator KENNETH HERTZ, is a Senior Partner in the Beverly Hills law firm of Goldring Hertz Lichtenstein and Haft LLP. Although Ken (through various partnerships) consults a number of firms engaged in businesses operating in the digital content, technology and entertainment marketing space (including Tiger Electronics, Hasbro Toys, Alliance, Big Champagne, IE Marketing, BMG and The Estate of Elvis Presley, IDJ, SongPro, Paul Frank Industries, and Noizeplay), Ken and his partners specialize in representing talent in the entertainment industries. The firm's clients include such artists as Will Smith, Destiny's Child, Herbie Hancock, Boyz II Men, Christina Aguilera, No Doubt and Alanis Morisette. Prior to joining the firm, Ken was in charge of music -- business and legal affairs -- for The Walt Disney Company. Ken is a frequent speaker on the subjects of music, convergence and technology, and along with his partner, Fred Goldring, recently taught a course on Management Issues in the Music Industry at UCLA's Anderson Graduate School of Management. Michael Goodman joined the Yankee Group as a senior research analy st for the Media & Entertainment Strategies Planning Service in January 1999. Mr. Goodmans responsibilities include research and analysis for the converging media and entertainment products and services among consumers. This includes such topics as broadband entertainment (movies, music and games), high-speed Internet (cable modems and satellite), cable television (from the prospective of both programmers and cable operators), direct broadcast satellite (DBS), broadcast television. Mr. Goodman has extensive knowledge of the marketing issues facing record labels, retailers, broadcast and cable, direct broadcast satellite (DBS), and consumer electronics. His other areas of expertise include audience research (television ratings), market research, and project management. Prior to joining the Yankee Group, Mr. Goodman was a marketing representative for Nielsen Media Research, where he was responsible for the design, management, analysis, and marketing of custom research projects. In addition to television audience research, topics covered included the penetration and usage of new technologies in the home, consumer satisfaction, market profiles, and concept testing. Prior to his position at Nielsen Media Research, Mr. Goodman held several positions with VOPAN Marketing Research, conducting market research on consumer products.Marc Morgenstern is Chief Executive Officer of Overpeer, Inc, the leading provider of anti-piracy and customer referral services on peer-to-peer networks. Since joining Overpeer in 2001, Morgenstern has built enduring customer partnerships with many of the most important music, film, game and software companies worldwide. Overpeer is the latest venture in a long career in the media and entertainment business that has included executive positions in music, television, Internet, print and strategic consulting. Morgenstern was formerly President, Music Group of RightSpring Inc., an on-line marketplace for music and photography rights. At RightSpring, Morgenstern negotiated partnerships with leading music labels and publishers and also led all sales and marketing efforts with professional music users, including the advertising industry, film and television music supervisors, and the web production community. Previously, Morgenstern was executive vice president of the Enterprises Group at ASCAP (American Society of Composers, Authors and Publishers) the world's largest performing rights organization. He headed all new media licensing activities as well as ASCAP's partnerships with various technology and content companies. During his tenure at the company, Morgenstern served as ASCAP's representative on various international rights tribunals including SDMI. Earlier in his career, Morgenstern was a consultant on strategy, organization and communications issues to leading entertainment and media companies. As a principal at the Sucherman Consulting Group, Morgenstern advised a leading cable network on revising its brand focus and streamlining its production processes, counseled a major studio on integrating a merger partner, and guided a leading technology company on its entry into entertainment-related businesses, among many other senior-level engagements. Over the years, Morgenstern has appeared on many panel discussions on new media issues around the world. He has also been quoted in leading publications such as the Wall Street Journal, New York Times, Washington Post, Wired and CNET. Morgenstern is a multi-Emmy winner who earlier in his career worked as a producer and news executive for the CBS television stations in New York and Los Angeles. Earlier, he served as a newspaper reporter and editor for the Washington Post Company. He graduated with a BA from Yale University, where he was editor of the Yale Daily News and winner of the Suisman Reporting Prize. |
