The Piracy Freight Train: As Entertainment, The Law & The Technology Collide
While there may be no short term fix when it comes to the evolving relationship of the digital technologies and its impact on music, film and information content distribution, what we can perhaps all agree on is that it is becoming a more sophisticated and complex relationship. As broadband grows, with it come not only threats to rights holders, but also potential solutions and new attitudes in public behavior. All the news is not bad. While the adversarial positions in the legal process may not be softening and the legislative proposals continue to weave through the system, there are many factors in the technological space as well as in the marketplace which may come to mitigate or even change the flow of history. In this session, we bring together a group of the primary players in the field, looking to exchange ideas and give us a roadmap for the future.

David Mathias, Senior Manager, Strategy & Operations/TMT Practice, Deloitte Con sulting LLP: David Mathias is a Senior Manager in the Strategy & Operations practice of Deloitte Consulting LLP, focusing on the Media & Entertainment Industry. He has over 16 years of industry and consulting experience including positions with both film and television studios and content publishing firms. David has focused on areas such as content security, digital asset management, third party payment systems, network broadcast operations, sales force effectiveness, marketing, and IT strategy. He has extensive experience with strategy and business development, tactical implementation, operational process improvement, change management and financial analysis. In addition, David has been instrumental in developing Deloitte's thought leadership on content security and intellectual property management.
Ian C. Ballon, Shareholder, Greenberg Traurig LLP: Ian Ballon represents technolo gy, media and entertainment companies in complex litigation and counseling relating to copyright, trademark, trade secret, database and computer and Internet law issues. Mr. Ballon, who splits his time between the firm's Palo Alto and Los Angeles offices, is the author of the three-volume legal treatise, "E-Commerce and Internet Law: Treatise With Forms" (LegalWorks/ West Publishing 2001 & 2005 Supp., which has been cited in state and federal court opinions. He also serves as Executive Director of Stanford University Law School's Center for E-Commerce . In addition, Mr. Ballon is an Advisor to the American Law Institute's International Intellectual Property Jurisdiction Project, a Council Member of the American Bar Association's Section of Science and Technology, and a member of the GRAMMY® Foundation's Entertainment Law Initiative Advisory Committee. Mr. Ballon frequently speaks and writes about intellectual property and Internet law and is regularly quoted on these subjects in general-circulation and industry publications. Michael Petricone, Vice President, Consumer Electronics Association: Michael P etricone is the vice president of technology policy for the Consumer Electronics Association (CEA) where he manages the government and legal affairs department. In his position, Michael is responsible for developing and implementing the public policy priorities of CEA. He represents the technology industry's position before Congress, the Executive Branch and administrative agencies on issues such as digital rights management, broadband, and privacy. Mr. Petricone is a frequent public speaker on issues impacting the consumer electronics industry. Mr. Petricone received his law degree from Georgetown University Law Center and his undergraduate degree from Tufts University. He resides in Washington D.C. CEA represents more than 1000 U.S. manufacturers of audio, video, accessories, mobile electronics, communication, information and multimedia products that are sold through consumer channels. CEA also sponsors and manages the International Consumer Electronics Show (CES), the world's largest annual trade event showcasing consumer electronics products.
Rajan Samtani, Director, Sales & Marketing, ContentGuard: As the Director of Sales & Marketing at ContentGuard, Inc., Rajan Samtani is responsible for all market-facing activities, including marketing, PR and customer engagements. Before ContentGuard, Rajan was a founder of TheDealerNetwork, Inc., a B-2-B exchange in the personal computer industry. Prior to that he was VP of Sales and Marketing at REAL Software Systems, the leading application software vendor dealing with business rights and royalties in the entertainment, media, publishing and software markets. Rajan has a BA in Economics from UCLA and has taken several executive education courses at the Wharton school of Business.
Russell Frackman, , Partner, Mitchell Silberberg & Knupp: One of the most ac complished litigators of our time, he has been at the forefront of Intellectual Property protection. He served as lead counsel for the record company plaintiffs in the major internet file sharing litigation A&M Records, Inc. v. Napster in 2001 as well as for the case against Grokster. Along the way, he has earned two gold records from the RIAA. His heralded work for the music industry and the motion picture industry has set much of the case law that today's content providers must adhere to. A leader in all facets of intellectual property, he recently represented a prominent adult magazine and Web site in a high profile copyright infringement suit against major online search engine, Google, Inc., where he obtained a preliminary injunction enjoining aspects of the display of thumbnail images owned by the client.
David E. Leibowitz is Managing Partner of CH POTOMAC, a strategic services firm working with companies at the intersection of entertainment, media and technology. Mr. Leibowitz brings almost thirty years of experience in business, law and policy issues facing the entertainment, new media, consumer electronics and information technology industries. Among other activities, Mr. Leibowitz serves as a senior advisor to Gotuit Media, Motorola, National Datacast, Gibson Guitar, Peppercoin, myMPO, and Demand ID Systems. Mr. Leibowitz also has worked with other clients, including BMI, 13 Colonies Software (since purchased by a large enterprise software company), CD Intelligence, and Neurok Optics. Earlier in his career, Mr. Leibowitz Co-Founded VERANCE and served as it Chairman. VERANCE offers innovative technology solutions to protect, manage, and monitor audio and audiovisual content, including broadcast monitoring and verification, copy protection and content management. Before that, Mr. Leibowitz was Executive Vice President and General Counsel of the Recording Industry Association of America (RIAA), responsible for business and legal issues facing the industry with particular emphasis on how to position the industry to utilize new physical and electronic format systems. During this period, Mr. Leibowitz chaired the worldwide recording industrys International Steering Committee on DVD Audio, the RIAA New Technology and Multimedia Committee and the RIAA Legal Committee. Prior to his work at the RIAA, Mr. Leibowitz was a partner in the Washington, D.C., law firm Wiley Rein & Fielding representing a number of Fortune 100 media and entertainment companies. Mr. Leibowitz also has served as Policy Planning Advisor to the Register of Copyrights for the U.S. Copyright Office.
